We are consulting with parties affected by proposed technical updates to the following New Zealand Emissions Trading Scheme (NZ ETS) regulations.
The regulations are on the New Zealand Legislation website:
- Climate Change (General Exemptions) Order 2009
- Climate Change (Other Removal Activities) Regulations 2009
- Climate Change (Synthetic Greenhouse Gas Levies) Regulations 2013
- Climate Change (Stationary Energy and Industrial Processes) Regulations 2009
NZ ETS regulations require amending from time to time to update technical factors and address anomalies when they arise. This helps ensure the NZ ETS is fit for purpose and as accurate as possible.
This consultation is not related to the proposed Climate Change Response (Zero Carbon) Amendment Bill or proposed Emissions Trading Scheme improvements.
The consultation document provides information on the proposed technical updates and includes questions we would like your responses to.

Please include the following information with your submission:
- title of consultation
- your name and organisation name
- email or postal address.
Your submission can address any issues relating to the proposals. Your submission does not have to answer every question.
Final proposals will be put to the Minister for Climate Change and Cabinet for approval once we have considered submissions. Amendment regulations will be published in the New Zealand Gazette by late September following Cabinet approval.
Publishing and releasing submissions
All or part of any written submission (including names of submitters), may be published on the Ministry for the Environment’s website, www.mfe.govt.nz. Unless you clearly specify otherwise in your submission, the Ministry will consider that you have consented to website posting of both your submission and your name.
Contents of submissions may be released to the public under the Official Information Act 1982 following requests to the Ministry for the Environment (including via email). Please advise if you have any objection to the release of any information contained in a submission and, in particular, which part(s) you consider should be withheld, together with the reason(s) for withholding the information. We will take into account all such objections when responding to requests for copies of, and information on, submissions to this document under the Official Information Act.
The Privacy Act 1993 applies certain principles about the collection, use and disclosure of information about individuals by various agencies, including the Ministry for the Environment. It governs access by individuals to information about themselves held by agencies.
