Pursuant to section 188 of the Resource Management Act 1991, the Minister for the Environment, hereby gives the following notice:
1. Title and commencement (1) This notice may be cited as the Resource Management (Approval of Friends of Mount Street Cemetery Incorporated as Heritage Protection Authority) Notice 1994.
(2) This notice shall come into force on the 28th day after the date of its publication in the New Zealand Gazette.
2. Approval as heritage protection authority - The Friends of Mount Street Cemetery Incorporated is hereby approved as a heritage protection authority for the purpose of protecting the Mount Street Cemetery described as being:
All that parcel of land containing one acre twenty-three and seven-tenths perches (4646 square metres), more or less, situate in the City of Wellington, being part of Reserve 7 (Roman Catholic Cemetery), Town of Wellington and being also Lot 1 of Deposited Plan 8081. All certificate of title 370/113, Wellington Land Registry.
Subject to the following conditions:
(i) That the Friends of Mount Street Cemetery Incorporated do not give notice to the Wellington City Council of its requirement for a heritage order in respect of the Mount Street Cemetery until it has submitted a report of its financial position to the Secretary for the Environment; and
(ii) That the Friends of Mount Street Cemetery Incorporated submit an annual financial statement, in the same form as required by section 23 of the Incorporated Societies Act 1908, to the Secretary for the Environment.
