Resource Management (Discount on Administrative Charges) Regulations

The Resource Management (Discount on Administrative Charges) Regulations 2010 (the Regulations) were passed on 21 June 2010 and come into effect on 31 July 2010 to provide a ‘default’ discount.

The Regulations provide for a discount of 1 per cent per day, up to a maximum of 50 working days for resource consent applications not processed within timeframes in the RMA.  This amount is to be applied to both notified (including limited notified) and non-notified consent applications.

On 29 March 2010, the Government approved the policy for the discount regulations.

Full details of the policy for the Regulations approved by the Government, are available in the Cabinet paper: Resource Management Discount Regulations.  An analysis of the preferred options for the development of discount regulations is available in the Regulatory Impact Statement prepared by the Ministry for the Environment.

The Ministry has produced guidance material to accompany the regulations and flowcharts showing the resource consent process for non-notified, notified and limited notified applications.  The Ministry will also hold presentations on the regulations with local authorities in early July 2010.
