Difference between Representation and Evidence?

Representation

  • Representation is a statement of the decision the submitter wants the Court to make.
  • It is not made under oath and the submitter cannot be cross-examined by other parties or their lawyers.
  • A representation may highlight the main points of the submission, and may respond to submissions made by others.
  • All submitters may make representations additional to submissions filed but cannot go beyond the grounds of the submission.
  • Joint presentations (where one person makes a representation on behalf of several submitters) are allowed, and are encouraged where the submissions are of a similar nature.
  • Submitters may make their own representation themselves, or they may choose to be represented by a lawyer or other agent.

Evidence

  • Evidence is about matters of fact, or in the case of qualified experts, matters of opinion about issues within their field of expertise.
  • It is given under oath.
  • Persons giving evidence may be cross examined by other parties or their lawyers.

Circulation of Evidence

Each party is to provide 6paper copies and one electronic copy of their evidence to the Project Co-ordinator by 5pm on 22 May 2009. The Project Co-ordinator will then circulate the electronic evidence on CD to each party that has indicated that they wish to be heard.
