Viewing of the proposed route and sites

The Board has issued the following protocol that applies to all parties participating in the trips to view the proposed route and sites:

Protocols for taking views of sites and routes

  1. The purpose of taking a view is not to receive evidence, but to assist the decision-makers to understand better the evidence given at the public sittings.
  2. The applicant and submitters or their representatives who accompany the decision-makers should confine themselves to pointing out features that are described in evidence given at the public sittings.  The taking of a view is not an appropriate opportunity for giving evidence, or making or explaining representations in support of, or in opposition to, the proposals before the Board.
  3. All relevant participants in the Board’s inquiry are welcome to accompany the decision-makers when taking a view.  If practical, that should be done in such a way that all present can hear and see what the decision-makers hear and see.
  4. In this case, with 1,244 submitters, it will be impractical for all to attend individually, and hear and see what the Board members hear and see.  Submitters should agree among themselves on a small number of representatives to accompany the Board when taking a view.
  5. Decision-makers under the RMA have no power to enter private land to take a view, other than at the invitation of the occupier.  The Board could not accept an occupier’s invitation to enter private land to take a view unless the invitation extends to representatives of the applicant and of other submitters.
  6. If a decision-maker viewing the site or route observes something inconsistent, as a matter of primary fact (rather than judgement), with evidence adduced in the hearing, that perceived inconsistency is to be brought to attention at the public hearing so that there is opportunity for the perception of inconsistency to be resolved or explained.
