Can I appeal the decision?

There are limited rights of appeal against a decision to award costs. This is due to the fact that the decision involves a broad discretion and that appeals from the Environment Court to the High Court are on points of law only. However, the High Court is not a cost review authority and may also impose costs if it considers the appeal against costs was inappropriate.

Legal advice should be sought if you are considering appealing a costs decision.
