Public Notice of Application for a Water Conservation Order on the Hurunui River

In August 2007, the Minister for the Environment received an application for a water conservation order for the Hurunui River from the New Zealand and North Canterbury Fish and Game Councils and the New Zealand Recreational Canoeing Association. The application was supplemented by further information provided on 19 March 2008.

The application seeks a Water Conservation Order for the preservation and protection of outstanding features held by the following waters:

  • The mainstem of the upper Hurunui River and all of its lakes, tributaries and contributing waters (including hydraulically connected groundwaters) from its source in the Main Divide of the Southern Alps dawn to immediately above its confluence with the Mandamus River (Upper Hurunui Waters).
  • The mainstem of the lower Hurunui River from immediately above its confluence With the Mandamus River down to the Sea (Lower Hurunui River).

The applicants seek the Order as they consider that:

  • The Upper Hurunui Waters have outstanding amenity and intrinsic values which are afforded by the waters in their natural state and should be preserved in accordance with section 199(2) (a) of the Act.
  • The Lower Hurunui River contributes to outstanding characteristics and should be protected in accordance with section 299(2)(b) of the Act.

The Minister for the Environment has appointed a special tribunal to hear and report on the application. The special tribunal may consider matters wider than the matters raised in the application.

Any person may make a submission. Submissions should be made in writing on submission Form 30 and served on the Special Tribunal or emailed to the Administration Officer.

If you support the application but prefer that the Order instead preserve a different but related water body in the same catchment or that different features and qualities of the water body be preserved, your submission must state this preference and your reasons for this preference. In giving reasons, you must refer, if applicable, to the matters set out in sections 19.9.200 and 207 of the Resource Management Act 1991. You must also describe the provisions that you think should be included in the Order and the effects that those provisions would have on the water body.

If you oppose the making of the Order you must specify the reasons why you consider the proposed Order is not justified in terms of section 199 and section 207.
